Below are the general terms and conditions regulating online sales through the website www.tendeandmore.com. We invite you to read this document carefully as at the time of sending any orders you will be asked to declare their acknowledgment and acceptance.

1 – Product characteristics
The articles comply with what is reported in the descriptions and comply with all the standards and technical characteristics relating to similar products. For each article, various color photographs are available on the website: the images and photographs are reproduced as accurately as possible. Being manually produced items, there may be slight discrepancies from the photographs. The different settings of the monitors (screens) can also slightly alter the colors which may therefore be slightly dissimilar from the originals.
The declared measurements are to be understood as approximate and the normal tolerances inherent in textile products must be considered (+/- 3%).
As a rule, chenille curtains have a settling phase which involves growth in length, this should not be considered as a product defect, but normal behavior. During the packing phase, the chenille curtain undergoes a pressure that does not alter the product. It may initially be squashed, but once hung it will return soft and fluffy as it was originally.

3 – Delivery time
Our items depart from the warehouse in Sutrio (UD) and travel with appropriate and suitable packaging via the courier BRT Corriere Espresso, to be sent within the set times; generally within 10 work days from the order confirmation date (15-20 days for custom-made curtains).
Upon delivery of the goods by the courier, the customer is required to check it: that the number of packages delivered corresponds to what is indicated in the transport document; that the packaging is intact, not damaged, not wet or otherwise altered. Any damage to the packaging and / or items or the mismatch in the number of packages must be immediately contested, by placing a WRITTEN INSPECTION on the proof of delivery of the courier. Once the courier’s document has been signed, the customer cannot raise any objection regarding the external characteristics of the goods delivered.
Any problems concerning the physical integrity, correspondence or completeness of the items received must be reported by e-mail to info@tendeandmore.com within 10 days of the delivery. In the event of repeated impossibility of delivery of the order due to unavailability of the Customer and subsequent failure to collect within 5 work days of the stock at the courier’s warehouses, the order will be automatically canceled. All costs relating to transport, storage and return to the sender will be charged and retained in the refund.
Unless otherwise indicated in writing, all the prices indicated are to be understood as “VAT included” and expressed in Euro (€). The validity of the prices indicated is always and only that indicated by the procedure at the time of placing the order.
Products purchased through www.tendeandmore.com are protected by the manufacturer’s guarantee. This guarantee will apply exclusively to defects that have occurred despite the normal use of the product, that is, in compliance with its destination and with the provisions of any technical documentation. The guarantee will not be applicable in case of negligence, neglect in the use, handling and cleaning of the product. The guarantee is personal and will therefore only apply to the original purchaser, being reserved for direct customers and not for dealers, resellers, etc.
5 – Right to Withdrawal
For personalized or custom-made articles, the right of withdrawal will not be applied pursuant to article 55 paragraph 2 letter d) of Legislative Decree 6 September 2005 n. 206, as the right of withdrawal is excluded in the case of the supply of custom made or clearly personalized goods. The variation in length of the chenille is not considered a cause of withdrawal as it is not a production defect but it is a characteristic of the product. The fact that the chenille undergoes a pressure that in any case does not alter the product, may initially be squashed, but once hung it will return originally soft and fluffy and is not considered a reason for withdrawal.
6 – Modalities for the right of withdrawal
The right of withdrawal is however subject to the following conditions: according to the law, the contribution for the shipping costs related to the return of the goods is charged to the customer. The item must be returned intact, in the same conditions as when it was received. The item must be returned packed in the SAME PACKAGE used for shipping to the customer. Other types of packaging will not be accepted. The company will refund the customer within 7 work days from the return and after checking the integrity of the product in the amount paid, at the customer’s choice of credit for the replacement or purchase of another item. To exercise the right of withdrawal, the material must be intact in its packaging, packed and without any damage of any kind. Returns on cut material or damaged packaging are not accepted. The minimum unit for a return is one package.
To exercise the right of withdrawal, the Customer must send an email communication to info@tendeandmore.com, confirmed by registered mail within 48 hours, to the following address: Sutrio (UD) – Viale Basilio Di Ronco.
Within thirty days following the return of the goods, Arisol Srl will proceed with the refund to the Customer.
7 – Force Majeure
In any case of force majeure or unforeseeable circumstances, Arisol Srl is not responsible for delay or non-delivery and reserves the right to terminate the contract in whole or in part, suspend or postpone its execution.
8 – Privacy
The Customer expressly consents, in accordance with current legislation, to Arisol Srl, in the headquarters of Sutrio (UD) – Viale Basilio Di Ronco – the collection, use, communication and / or dissemination, for the purposes and conditions of indicated below, of their personal data as provided in the compilation of all the online forms necessary to complete their purchases, including what may be indicated in the Return / Withdrawal form. For the aforementioned purpose, the Customer declares to know and allow the data provided by him to be entered into the Customer Database and can be used for commercial, promotional and / or sales purposes as well as for statistics or for sending editorial material, by consultation, elaboration or comparison. The aforementioned data may also be communicated to other companies for the same purposes for which they were collected. The interested party may request confirmation of the existence of their personal data at the headquarters in Sutrio (UD) – Viale Basilio Di Ronco; know the origin, logic and purpose of the treatment; obtain updating, rectification and integration; request cancellation, transformation into an anonymous form or block in case of illegal treatment; oppose their treatment for legitimate reasons or in the case of use of the data for sending advertising material, commercial information, market research, direct sales and interactive commercial communication.
9 – Jurisdiction and Competent Court
This contract will be governed by Italian law. For any dispute concerning the validity, interpretation or execution of the same contract, the Court of Udine will have exclusive jurisdiction.

APPLICABLE LAW
The sales contract between the Customer and Arisol Srl is considered concluded in Italy and regulated by Italian law. The conditions of sale are regulated in particular by the DL 6 September 2005, nr. 206 on distance contracts and Legislative Decree 9 April 2003 N. 70 on certain aspects of electronic commerce.
